Terms of service

These terms govern your use of MemBraince, a hosted memory service operated by 1001636998 ONTARIO INC. ("we"). By creating an account or using the API, the MCP endpoint, or the Claude integrations, you agree to them.

The service

MemBraince stores the events and conversations you send, extracts memories from them, and returns relevant memories when you search. It is offered as a private beta: features may change, and there is no guaranteed availability or service level.

Your account and keys

Give accurate account information and keep your password, API keys, and recovery code secure. You are responsible for activity under your account and keys. Revoke a key in the portal as soon as you suspect it has been exposed.

Encryption and recovery

Encrypted accounts can only be unlocked with their API keys, Claude connections, or recovery code. We cannot read or recover encrypted content. If you lose access to all of them, your encrypted memories cannot be restored, and we are not responsible for that loss.

Your content

You keep all rights to the content you send. You give us permission to store, process, and transmit it only as needed to provide the service to you, including through the service providers named in our privacy policy. You must have the right to send the content, including any personal information about other people in it.

Acceptable use

Do not use MemBraince to break the law; to store content you have no right to; to attack, probe, or overload the service; to get around quotas, billing, or access controls; or to access other customers' data. We may suspend access that puts the service or other customers at risk.

Fees

Paid plans are billed monthly per saved event at the prices on the website: $0.0005 per save on Standard and $0.001 per save on Premium, in US dollars, plus applicable taxes. Billing is not live yet; we will tell you before any charge applies.

Ending the service

You may stop using MemBraince and ask us to close your account at any time. We may end or suspend accounts that break these terms. When an account is closed, its content is purged as described in the privacy policy.

Disclaimers

The service is provided as is and as available. Memories are produced automatically and may be incomplete or wrong; check anything important before relying on it. To the extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, profits, or revenue. Our total liability for any claim is limited to the fees you paid us in the 12 months before the claim.

Changes

We may update these terms. We will post changes here and update the date above; significant changes will be announced to account holders by email. Continuing to use the service after a change means you accept it.

Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Disputes will be heard by the courts of Ontario.
